Dear Mary and Family, Mrs. Akin, Sharon, Barb, Jeanne,
We were saddened to hear the news of Tom's passing.
Many fond memories of 'taking shots' and spirited ground hockey games in the Akin driveway.
'Tommy' (as he was known to us then) and I formed a limited (to two sets) partnership to become the first kids on the Windsor Elementary School Block to collect a complete set of Jello-O/Hostess (potato chips) airplane coins. Good sales-bargaining pitch on his part - as I had the larger field of grandmothers and aunts living nearby to pester on grocery shopping days to make outlandish Jell-O purchases. While 'Akes' (his youthful nickname), was a persuasive and shrewd trader for difficult to obtain coins. A formidable and winning merger. And, in retrospect, an early indicator of Tom's natural gift for negotiation; which prowess obviously served him well as evidenced in his being recognized as one of the country's leading and respected tax law practitioners.
Recall his returning from a trip to Maine with his parents one summer with the town's first 'sidewalk surfer', as skateboards were first called - which he generously loaned to me to use as a template to construct a plywood version. Not to mention, supplying one of his older sisters' (my belated apologies, Barb, or Sharon) roller skates for locomotion; which allowed us to conduct speed trials and races from a 'separate the intrepid from the timid' ('wild from the mild'?) take-off point on Alexander Street, above our good mutual friend, Paul 'Vonner' Vaughan's home. Fast Risky Business Times on Clifton Avenue.
Tommy's largesse continued, as he later passed along his ambitiously cultivated and conscientiously nurtured biggest 'Star Weekly' paper route in town to me.
High school found us although in different schools (KCS and WRHS) meeting in 'Diner' (the film) tradition after classes at 'Skeet Kilcup's Tobacco Store', 'Skeeter's' for short; to discuss local girls, sports, music, current events, politics, movie 'babes', out of town girls and occasionally touch on the future of western civilization as we then knew it, at the 'Skeeter's Après School Coca-Cola Cooler Club'. Again, as a precursor to Tom's professional destiny, I recall his holding court passionately on the advantages (to the taxpayer) of the U.S. Federal Capital Gains Tax relative to its Canadian counterpart. The only teenager (heck, one of the few people in the entire town) that I knew, who was aware of and had a bear trap grasp on that little tax deductible nicety.
(Tom joins Daryl 'Dink' Slaunwhite, another of the infamous 'Skeeter Club Five' to have been taken from the conversation far too soon. Kenny Draper at the cash register, Paul 'Vonner' Vaughan and myself lounging against the Coke cooler, rounded out that eclectic and always entertaining quintet.)
We later, along with fellow (alleged/possible) Birthplace of Hockey and Tonge Hill resident, Bruce 'Goose' Lake went on to share an apartment (inherited from Tom's sister Sharon and her colleague - again, merci Sharon and Marilyn(?) in Halifax on Brussels Street, during my sophomore year at Dalhousie University. An eventful school year that saw all three of our girlfriends, soon to be (and still our) wives, uhh... 'with child', er, children.
What are the odds that three young men living under the same roof would experience coincidental latex failures (allergies?) Forghedaboud eating brussels sprouts to enhance health and fertility, simply book a romantic night with your loved one on fecund Brussels Street in Halifax, Nova Scotia.
Apart from sharing an apartment, Akes and I shared (suffered?) along with 'Vonner', 'the slings and arrows of outrageous fortune' that beset our beloved Chicago (then) Black Hawks, now 'Blackhawks.' Chicago fans being few and far between back in the NHL's 'Original Six' era in a town rife with Leaf and Canadiens fans.
A delightful parting image came into mind while writing this - it's dusk and a light snow is falling on the frozen quarry pond off Clifton Avenue ~ the 'big quarry', where the Ferry Hill guys played and three games could be played simultaneously and which we eventually inherited, when the Hill gang outgrew pond hockey ~ the old street lamps alongside the Sam Slick end of the quarry have just come on ~ "It's HNOC (Hockey Night Off Clifton) sports fans!" ~ Tom 'Bradley', 'Studley', 'The Young Stud' Akin is futilely and very comically trying to gain some traction (we'd been playing an endless game of pond hockey in our winter boots) after sliding by the puck, yet again... to execute a turn, gather up the biscuit and take off on a breakaway ~ IF only he can get a grip.
And then, not unlike a cartoon character, he struck friction gold and was off - "all alone on a clear-cut breakaway skating running left-to-right on your radio dial!!" ~ duffle coat wide open and flapping, hair flying in the breeze as he gathered speed, head tilted back, an unlit cigarette incongruously clenched between his teeth falls to the ice as he laughs triumphantly... and lets loose with a jubilant 'You Can't Catch Me!' howl into the snow dome twilight.
Thanks for the laughs and now and then, prized shotgun seat on the 'Stephens & Yeaton's to Gordon's Grill' loop, Akes.' Our thoughts are with you Mary.

Dear Mrs Akin, Sharon, Barb and Jean;
My brother Jim left a message on my answering machine with the terrible news about Tom. Patricia and I were out of the country and were just returning the day of the memorial or I would have been there. Our families were so close for such a long time and, even though we have been out of touch lately, I had to write to say how sorry I am to hear about Tom. Such an intelligent and talented man with so much more to give in this world. It must be a very difficult time for you all. Dear Mary,
Just a note to tell you how sorry I am for your loss.
I first met Tom in 1977 and although we were nominally competitors, throughout our careers, I enjoyed all of my dealings with Tom. It was impossible not to like Tom.
Tom's kind and gentle manner made him a role model for both junior and senior lawyers. He had the knack for resolving seemingly intractable conflicts by spotting a solution that everyone could live with and then using his tact to persuade each side to sign on.
In addition to his leading role as a tax partner at McCarthys, Tom made substantial contributions through his participation and leadership at many organizations including the Canadian Bar Association, the American Bar Association, the Canadian Tax Foundation and the Toronto Board of Trade. He deservedly had an international reputation as a first class lawyer (and person).
We will all miss Tom terribly. I know this is a difficult time for you and your family. if I can help in any way, please let me know.

Dearest Mary, Holly, Thomas and Matt
It was with great sadness that Tsahai and I learned of Tom's passing this last week. You have been in our thoughts and prayers during what I can only imagine is a difficult time for the family. As many have attested here, Tom was a man of many talents, but I will always remember him for being a warm and welcoming presence, treating me like a member of the family. Those years through high school that I spent with Thomas and everyone were some of the most cherished memories of my life. I will always remember them fondly.
Among the many memories, there is one memory of Tom I'd like to share. It would be one of the last one's that I have of him and I think, adequately describes the passion he held for his family.
While I saw his commitment to his family on many an occasions, I witnessed this to great effect at Thomas and Sophie's wedding in 2012. When the ceremony, speeches and dinner had been completed, Tom was the first person to the dance floor. He had a blast dancing to some great oldies, dancing with Mary, his granddaughter and his kids. He really led the festivities! At one point when he sat down to take a break, I glanced at him and saw an expression on his face that at the time was difficult to nail down. Was it joy? Contentment? Pride? To be honest, I think it was all these things and much more. It seemed as though that moment had been his life's work - that for him there was no greater joy then being surrounded by his family. He had the look and feel of the most accomplished man in the room. As a father with two children, I remember thinking at the time, that I too, would hope to have a similar expression on my face at my daughter's wedding. Plato said 'caring about the happiness of others, we find our own'. When I think of Tom, I think this is exactly what Plato meant.
I'll miss you Mr. Akin. Thank you for being a powerful example of what a man, husband and father can be. You were truly one of a kind.

Tom was a neighbour of mine and a fellow tax practitioner for over 20 years.
Tom was held in the highest esteem by his clients... which were far too numerous from my perspective. He had a unique ability - as many of his clients kept telling me - to get normally uncooperative Revenue Canada officials to see things his way. I always attributed that gift to his Nova Scotia roots.
As a neighbour, it was always comforting to see Tom out there weeding his own lawn, putting up his own Christmas lights and washing his BMWs. It was a rather unusual sight in Lawrence Park.
Although we were not members of the same firm, it seemed as though we almost were. It was comforting to be able to wander over and chat with him when the challenges of being a tax lawyer were particularly pronounced. I spent many evenings working away in my den, feeling rather hard done by, but could take some solace from the fact that I could see Tom from my window, also toiling away in his den. I think we were motivated by the same passion for our professions.

Dear Mary and family,
It is very difficult to find the right words to describe our sadness in learning of Tom's passing. Mary, you, Tom and your children are very special friends and neighbours. Since we arrived on Glenallan Road 23 years ago, the Akin family have been a wonderful part of our lives, as our children grew up together. We have enjoyed many, many great times together, celebrating birthdays, Christmas, New Years, skiing Lake Louise and of course trips to Marco Island.
We will miss Tom so much, but we will always remember his smile, his kindness, his sense of humor, his intellect and his determination to fix anything that is not quite right.
We think about you and your family every day and how sad you must feel. Hopefully, over time,the many happy memories will help ease the pain. We will always be there for you in help and support, and love all of you dearly.

Tom and I had a special relationship. I was the last lawyer who sat in the well-worn mentee chair in his office. Tom spent countless hours teaching that the secret to being a great tax lawyer was to have fun and to build relationships. Tom truly loved his job. He would run down the hall with a smile every time there was a new problem to solve. Tom was selfless. He believed that passing on the torch would be his legacy going so far as to have me join him on stage at the biggest tax conference.
Tom was a master story teller. Tales of his Supreme Court victory in Toronto College Park were told, at least twice daily, always with a twinkle in his eye.
Travelling with Tom was an adventure. He considered speed limits to be poorly suggested minimums. Air Canada gave him the full celebrity treatment with a secret hotline, curbside greetings, and golf cart sprints to the gate.
When I left McCarthys, chair sessions turned into frequent calls to discuss life, law, and technology. He was my first call for advice. I strove to make him proud. He loved telling me stories about little Tommy the east coast trouble maker and his early days with Mary. His favourite topic was the latest and greatest ways that he could dote on his grandkids.
Tom loved his catch phrases. In tribute, I will conclude with his most famous: ‘The long and the short of it is’ that Tom was a great mentor, lawyer, and friend. He will be missed.

As I am sure is the case with many of Tom’s friends, I have spent the last few days trying to accept and come to grips with the reality of the very sad news of Tom’s passing last Wednesday morning. During much of that time, I have been thinking about the long relationship I had with Tom, and the wonderful memories of times we spent together.
Tom and I met almost 40 years ago when we both began our articles at what was then McCarthy & McCarthy. Tom had a very early influence on my career. I didn’t really know what I wanted to do, but did have some thoughts about being a tax lawyer, given that my highest aptitudes were for maths and sciences and so tax seemed as good a fit as any among the legal disciplines. But I could see that Tom was going to be a tax lawyer and was well advanced in his preparation for that role, as well as being very smart. I quickly realized that McCarthy’s was unlikely to hire more than one new tax lawyer and that Tom was likely to be that one, so I looked around for other alternatives. Fortunately, I managed to stay on with the firm (I think my niche was touch football) and thus become Tom’s colleague, partner and, most importantly, friend.
As a practising lawyer, Tom was generally in to the office quite early. As I recall, that wasn’t always the case when we articled. I think the first time he arrived somewhat latish in the morning he mentioned a truck jack-knifed on the Don Valley, and so that became a bit of a running joke when he would arrive a bit late. Back then in his pre-BMW days, he drove an old Maverick, I believe, which he almost literally drove into the ground. He used to say that Holly and Thomas wouldn’t let him drop them off to close to the school for fear of being seen in it – I wasn’t sure if that was true or just made for a good story. Ultimately, many years later, one influence I had on Tom was to persuade him to try a BMW, after which he was hooked.
Although I didn’t work with Tom on files involving what eventually became his specialities, I did get to work with him on some files that involved income tax, something that he was also very good at even if he didn’t have much time for he once he became in demand for his more specialized skills. I always enjoyed working with smart people, and Tom was one of the smartest. We were also involved together in trying to make the firm run in a bit more of a business-like manner.
Tom and I became good friends and spent a lot of time together on non-work activities such as squash and golf. We started playing squash at some courts in the apartment complex where Tom and Mary lived when they first came to Toronto. Neither of us had played all that much, although I had played a bit more and at first could beat him fairly easily. It didn’t take long for Tom to catch up and for a long time we were quite evenly matched, but after my first eye surgeries I stopped playing with anyone other than Tom and after that more often Tom would have the upper hand. Fortunately for me he still wanted to play with me and if I was seeing the ball decently on a given day we would at least have a good workout. After his heart problem, we would always take a little break when his heart monitor beeped, but I am pretty sure my heart rate was higher than his at those times.
We also went on a number of golf trips together, sometimes just the two of us and sometimes with Jim Wilson and Iain Scott. I remember the first time we went to Myrtle Beach when we drove down and I learned about Tom’s capacity for going a long time without food and why he could do so. We left Toronto early in the morning and it was after 2:30 in the afternoon when I finally said that I was famished and needed to stop for something to eat. Tom somewhat reluctantly agreed. We stopped at a fast food place and each ordered what I thought was a fairly large meal. When Tom finished his, he went back and ordered the same thing again. Since I couldn’t duplicate his camel-like eating capacity, after that I insisted on a more regular eating schedule. On that trip we were on a tight budget, and so shared a room. One day, Tom was practising some swings with his wedge in our hotel room when he took a fair-sized divot out of the carpet. Like any good golfer, he replaced his divot and I don’t think we were ever billed for the damage. On later trips to places like Bay Hill, Pinehurst, Scottsdale, Las Vegas and Pebble Beach, we enjoyed more luxurious accommodations and shared the benefits of Tom’s travel expertise, including benefitting from his royal treatment as a result of his Super Elite status and from his many discount cards. Tom made travelling easier, and I remember one time I was travelling with Jim on business and we were standing in a long line at the airport discussing how different it would be if Tom were there and hoping he didn’t come along and see us in this sorry state. On those golf trips, the golf was often mediocre, but the food and wine were always first rate and the company was always great. Sometimes we did try to do too much – when Tom and I went to Las Vegas, we flew out in the morning, checked in, played golf, went out for a nice dinner and then went to the late Cirque de Soleil show. It started at 11:00 Las Vegas time, which was of course 2:00 am Toronto time. I think we are the only two people ever to fall asleep during a very exciting Cirque show!
Tom was a top-notch lawyer and a great friend, but above all else he was a wonderful family man. His family was always his top priority, and his pride in all of them was obvious to all of his friends. We saw less of each other after I stopped coming in to the city to work, but all of our conversations included updates on how the family was doing and that pride was always reflected in his comments. I was fortunate in that Tom and I played together just a couple of weeks ago in a charity golf tournament. We spent most of the day together, and much of the conversation was about his favourite topic, family (and his second favourite topic, dividend paying stocks). While Tom excelled as a tax lawyer, it is certainly my impression that he also excelled as a loving husband, father and grandfather. I know that those of us who were Tom’s friends are feeling a gaping hole in our lives with his passing, and I can only imagine the loss the members of Tom’s family are feeling right now. I take some comfort in the fact that if I have so many great memories of times with Tom, Mary, Holly, Thomas and Matthew must have a treasure trove of such memories. With the healing passage of time, I am sure that those memories will help in dealing with the hurt of missing a great person like Tom.

I had the privilege of being yours and your husbands travel agent for the past year. I was very sorry to learn of Tom’s passing. Over the years I have had many opportunities to interact with Tom professionally. On a personal level I often enjoyed discussing the intricacies of Aeroplan and air travel in general with Tom. He could have written a book on that subject.

I'm so sorry to hear of Tom's untimely passing. He was a real gentleman, well respected in the world of tax professionals. I always enjoyed meeting him and speaking with him at conferences.
