Dear Janice & Family, I learned with great sadness of David’s passing and on behalf of myself and my family – all of whom got to know him - , I extend our deepest sympathy. I first met him when I became an Advisory Counsel at Justice when, I think, he was serving as a Senior Counsel for our department in Finance. To him, the public service was just that – an honourable pursuit of the public good through government. Our paths continued to cross – in Saint John when he was recruiting for the Department and during my many stints during summers working in Ottawa when he and Elaine would have me and sometimes my wife Marie as guests at their home. This led to a lifelong friendship between our two families, and all of us have fond memories of both of them and you, and we were frequently in one another’s houses or their cottage for parties. Together we were always full of fun. My children all fondly remember him and your mother and the times they spent with you when you were all children. I remember various steps of his distinguished career. He developed several new approaches to the job while he was in “Combines”. He was also a remarkably able judge and I recall citing him on a number of occasions when I too followed that career path. Periodically we would meet at Bar meetings, and we always made sure that the four of us got together. All of this to say that I hope you will take some comfort from knowing that his many friends share in your sadness.

David was a good friend. We both served during the Second War, albeit in different branches of the service and in different theatres, and both served through the law, albeit in different ways. David worked hard, listened well, and cared a lot. We always had much to talk about. He was always interested in a dozen oysters. He will be missed.

The Honourable Justice David Henry (he always urged me to call him David, but I could never bring myself to do so) was a great student of and contributor to Canada and Canadian law. He and Elaine were expecting Janice at the same time as my parents, Ernie and Sylvia, were expecting me. Even when apart, our families kept in touch. We always delighted in Justice Henry's company. He was always generous with his time. He was a great raconteur, and had such an interesting life that he had an anecdote for or about every occasion. He was instrumental in starting my legal career, recommending me to his Alma Mater, Osgoode Hall Law School, which ,no doubt against its better judgment, admitted me. He will be greatly missed but his contributions stand as a lasting tribute.

To David, elevated status had one purpose and one purpose only, and that is to make possible exemplary public service. He had, in abundance, the attributes of a good judge: courtesy, patience, compassion, thoughtfulness, an analytical mind, and common sense. I never heard him say an unkind word about anyone. I was privileged to be his colleague.

The Honourable David Henry was a great inspiration to younger members of the Bench and Bar. Although he retired from the Bench 20 years ago, his judgments are quoted today because they articulate timeless legal principles. He was the embodiment of civility in his interaction with others. Janice, Morten and Catherine, Christian and Anna, when we did not see you at the cottage this weekend, I felt there might be something wrong and then heard the news of Uncle David's death. So many precious memories of Hampson-Henry family times in Ottawa, McGregor Lake and Toronto come flooding back. You are all in our thoughts and hearts. Helen and I are very sorry to hear of the passing of David. He was a great neighbour. I remember when we needed to take down the tree in our back yard and had to use David's driveway to get it out. When asked if we could put heavy equipment in his yard he replied that it was the neighbourly thing to do. When I delivered a small token after the event (a bottle of scotch) to thank him he was very pleased. I remember how kind he was to us in this and many other things. Louise and I are very saddened to hear of David's passing. On many Saturdays upon our return from the market, Louise enjoyed taking David cheeses and applles- she always knew various cheese liked and would provide a variety of choices. I enjoyed taking David for his haircuts and observing the banter with the barber and other clients. I would drive a different route so David could admire the various changes. We lost Elaine a few years ago and the home was never quite the same and they were BOTH treasures. God Speed - David and thank-you for your sacrifices during the war years.
